Intrador Website Terms of Use – Institute of Pain Treatment

1. Acceptance of Terms

By accessing and using the Intrador – Institute of Pain Treatment website (hereinafter "Intrador", "Clinic" or "Site"), the user declares to have read, understood, and fully accepted these Terms of Use and the associated Privacy Policy. The use of the site is conditioned on the prior acceptance of the provisions established herein, which constitute an adhesion contract. Continued use of the site implies agreement with all provided conditions and implies the commitment to comply with them.

2. Definitions

For the purposes of these Terms of Use, the following are considered:

  • User: any natural person who accesses or uses the information or services made available on the Site.

3. Legal Framework

These Terms of Use were drafted in compliance with Brazilian laws, in particular:

  • Federal Constitution;
  • Civil Code;
  • Consumer Protection Code (Law No. 8.078/1990);
  • Brazilian Civil Rights Framework for the Internet (Law No. 12.965/2014);

All information is provided clearly and objectively to avoid ambiguities and misunderstandings. Procedures descriptions are for educational and clarification purposes and do not replace consultation or individualized medical care. Site communications follow Brazilian medical advertising rules (CFM) and do not constitute any guarantee of results. Intrador strives to keep the Site available continuously. However, temporary unavailability may occur due to technical reasons, maintenance, or force majeure. When the computerized system is unavailable, users may contact us through the channels informed on this page for clarification or support.

5. User Rights

In compliance with Brazilian legislation and good medical practices, users have the right to:

  • Respect and equal treatment by the Clinic, without discrimination of any kind.
  • Accessibility and adequacy of the service to their needs, including clear information about the treatments offered.
  • Protection of privacy, private life, honor, and image, as well as a guarantee that their personal data will be treated securely and transparently.
  • Confirmation, access, and correction of personal data, being able to request that Intrador confirm the existence of data processing, provide a copy, or rectify incorrect information.
  • Limitation of processing, opposition, and data portability, under the terms of the LGPD.
  • Not to be subject to automated decisions that affect their interests without human intervention.

To exercise their rights, the user must follow the procedures described in the Privacy Policy, contacting the Data Processing Officer through the indicated contact channels.

6. User Responsibilities

By using the Site, the user commits to:

  • Provide true and complete information in registrations and forms, being responsible for the veracity and updating of such data.
  • Use the Site ethically and in good faith, without causing damage, interruptions, or interference in systems. It is prohibited to insert viruses, malware, or codes that compromise the functioning of the Site.
  • Maintain confidentiality of logins and passwords, when there is a restricted access area, and not share them with third parties.
  • Ensure the security of the access device, keeping protection programs updated and using reliable networks.

7. Intrador Responsibilities

Intrador commits to:

  • Protect collected personal data through appropriate technical and administrative security measures, in compliance with the LGPD.
  • Not share personal data improperly with third parties, except in cases provided for by law or in the Privacy Policy.
  • Maintain the Site functional and secure within reasonable technical limits, without guaranteeing that access will be free of failures or interruptions.
  • Be responsible only for direct damages eventually caused by proven fault of the Clinic. We are not responsible for unavailability of user equipment, connection failures, system vulnerabilities, clandestine monitoring of devices, or misuse by third parties.

8. Intellectual Property

All content available on the Site (texts, trademarks, logos, images, videos, sounds, software, source code, design, and layout) is the exclusive property of Intrador or third parties who have granted a license for use. These materials are protected by national laws and international treaties on copyright, trademarks, patents, models, and industrial designs.

13. Forum and Applicable Law

These Terms shall be governed and interpreted in accordance with Brazilian legislation. Any claim or controversy arising from the use of the Site shall be submitted exclusively to the forum of the District of Recife, Pernambuco, unless otherwise provided by specific legal rule. This clause does not prevent users from filing complaints with the National Data Protection Authority (ANPD) or other competent regulatory bodies.

14. Final Provisions

  • Integration: If any provision of these Terms is considered null or unenforceable, the other clauses remain in force and producing effects.
  • Tolerance: Any tolerance by Intrador regarding the non-compliance with any obligation established herein does not imply waiver of right or novation.
  • Validity: These Terms enter into force on the date of their publication on the Site and will remain in force until a new version replaces them.
